Baidu Intelligent Cloud Block Storage Trusted Cloud

1. Service scope

The Cloud Disk Service (CDS) is a secure, reliable, and highly flexible storage service that functions as an expandable block storage component for Baidu Cloud Compute. It ensures high availability and large capacity support for CDS data storage. The Cloud Disk Service does not directly upload, provide, modify, or edit user-stored content.

2. Service availability

2.1.During the effective period of the applicable Baidu Open Cloud User Service Agreement, Baidu AI Cloud Disk Service promises to maintain at least 99.95% availability for normal user access in each calendar month. If Baidu AI Cloud Disk Service fails to meet SLA requirements while the user fulfills obligations under this SLA, the user is eligible for compensation in accordance with the following rules.

2.2. Baidu AI Cloud Disk Service CDS guarantees at least 99.95% availability for normal user operations during each calendar month. This equates to a monthly service uptime of 30 days × 24 hours × 60 minutes × 99.95% = 43,178.4 minutes Thus, it results in 43200-43178.4=21.6 minutes of unavailable time. Unavailable time refers to the duration when a single user's single Baidu AI Cloud Disk Server cannot be read or written normally.

3. Data storage durability

The Baidu AI Cloud Disk Server uses multi-replica storage technology, ensuring data durability of no less than 99.9999999%. The counting period is based on calendar months, with partial months considered as full months. Data usage is measured in MB.

4. Data storage destructibility

Users acknowledge and accept that data they actively delete cannot be recovered. Users also understand that when servers hosting Baidu AI Cloud Disk Service are retired or faulty hard drives are removed, data will be erased and cannot be restored. The service thoroughly deletes user data by overwriting it with "0" multiple times, and faulty disks are physically destroyed during decommissioning.

5. Data migratability

Data stored by users on the Baidu AI Cloud Disk Service can be read and written through Baidu Cloud Compute (BCC). Users have the freedom to select their preferred file system format for the Baidu AI Cloud Disk Service and use standard data migration tools for importing and exporting data.

6. Data privacy

Baidu and its users mutually agree to ensure that data stored by users on the Baidu AI Cloud Disk Service is isolated by user dimension through Overlay network technology. Without proper user authorization, other users, including Baidu Open Cloud, cannot access stored data. All operational and maintenance activities performed by Baidu Open Cloud are logged and preserved.

7. Data transparency right

Except as mandated by local laws, regulations, or to meet government regulatory/audit requirements, user data, applications, and activity logs will not be disclosed to third parties. All user data will remain stored within domestic data centers and will not be used for overseas operations or data analysis. Currently, Baidu Open Cloud's data centers are located in Beijing, and user data is stored in the region chosen by the user (data center). The count of CDS replicas is detailed in the relevant technical documentation. Users can also create snapshot backups for the Cloud Disk Server (CDS). CDS data is stored in Baidu's data centers within China.

8. Data auditability

Baidu will not disclose, edit, or reveal users' personal information or non-public content stored in Baidu AI Cloud Disk Service without legal authorization, except under the following circumstances:

(1) Relevant laws and regulations or the legal service procedures of Baidu AI Cloud Disk Service;

(2) Safeguard the rights of users and the public in emergencies;

(3) Safeguard Baidu's trademark rights, patent rights, and any other legitimate rights and interests;

(4) Situations where disclosure, editing, or sharing of personal information is legally mandated.

9. Service functions

The Baidu AI Cloud Disk Service (CDS) operates independently of Baidu Cloud Compute, offering functionalities like rapid capacity expansion, snapshots, and rollback support.

10. Service resource allocation capability

Baidu Open Cloud guarantees users that when applying for Cloud Disk Server quota expansion up to twice the normal quota, the process will be completed within 1 hour. For expansions exceeding twice the account quota, users are advised to contact Baidu Open Cloud customer service for completion time inquiries.

The quota allocation for Baidu AI Cloud Disk Service is set at 5 times the quota of Baidu AI Cloud Service, supporting online resizing and expansion capabilities.

11. Service fault recovery capability

Baidu Open Cloud ensures robust fault recovery capabilities for its cloud disk service through a comprehensive fault management system, which includes fault monitoring, rapid diagnostics, self-healing mechanisms, and automated alerts. Fault recovery methods include online migration, offline migration, and degraded recovery.

12. Network access performance

The storage nodes of Baidu AI Cloud Disk Service and the host machines of Baidu Cloud Compute are connected via 10-gigabit networks. The Baidu AI Cloud Disk Service does not directly offer external-facing services.

13. Service billing accuracy

The Baidu AI Cloud Disk Service offers two billing options: subscription-based and pay-as-you-go. Subscription billing is calculated daily for yearly and monthly plans, while pay-as-you-go billing is calculated per minute. Users are required to pre-charge their Baidu Open Cloud accounts, and based on the account balance, they can purchase Baidu AI Cloud Disk Service with varying capacities and billing types as needed. Baidu AI Cloud Disk Service keeps original billing records for at least 3 months. Baidu Open Cloud's proprietary billing system ensures accurate disk usage metering for Baidu AI Cloud users.

14. Service change, termination terms and service compensation terms

14.1. Given the particularity of network services, users understand and agree that Cloud Disk Service reserves the right to modify, interrupt, or terminate part or all of the cloud disk services. If the changed, interrupted or terminated cloud disk service is free, Cloud Disk Server is not required to provide separate notification to users.
14.2. Users understand that the cloud disk service may perform periodic or aperiodical overhaul or maintenance for the platform providing cloud disk service or relevant equipment, which may cause interruption of charged cloud disk service in reasonable time. Baidu AI Cloud Disk Service bears no liability, but Baidu should provide prior notice whenever possible (informing users 5 working days in advance of changes).
14.3. The cloud disk service may change or delete certain functions. In such cases, the cloud disk service is not required to provide users with individual notification. Users understand and accept that once the service is canceled, their right to use the service will terminate immediately, and any information stored in the service may become irrecoverable.

14.6. Exemption clauses of service provider

15. Miscellaneous

You acknowledge and agree that trusted cloud certification is conducted annually. Therefore, Baidu AI Cloud will annually update and adjust its trusted cloud documentation in accordance with certification authority requirements and changes to Baidu AI Cloud products.
