          SLA-Service Level Agreement

          This Service Level Agreement (SLA) specifies the Service availability Level index and compensation scheme of the Baidu AI Cloud database DocDB for MongoDB provided by Baidu intelligent cloud to customers.

          1. Definition

          Service cycle: Means a service cycle is a natural month. Less than a month is not counted as a service cycle.

          Total minutes of service cycle is calculated by the total number of days in the service cycle of single cloud database DocDB for MongoDB instance *24 (hours) * 60 (minutes).

          Minutes of service unavailability: In consecutive minutes, all consecutive attempts by the customer to establish a connection with the specified cloud database DocDB for MongoDB instance fail, and the cloud database DocDB for MongoDB instance service is deemed unavailable in that minute. The sum of the unusable minutes of a single cloud database DocDB for MongoDB instance in a service cycle, that is, the unusable minutes of the service.

          Monthly service fee: Tthe total service fee paid for the single cloud database DocDB for MongoDB instance in a service cycle (i.e., A natural month). If the customer pays the service fee for more than one month at a time, the monthly service fee is calculated according to the number of months purchased.

          2. Service Availability

          2.1 Calculation Formula of Service Availability

          Service availability takes a single cloud database DocDB for MongoDB system instance as a dimension and is calculated as follows:

          2.2 Service Availability Commitment

          Baidu AI Cloud database DocDB for MongoDB promises that the service availability within each service cycle is not less than 99.95%. If the Baidu AI Cloud database DocDB for MongoDB fails to meet the above service availability promise, customers can apply for compensation.

          The scope of compensation does not include unavailability due to the following reasons:

          1. The system maintenance caused by Baidu AI Cloud notifying users in advance, including reasonable upgrade, change, shutdown, cutting, maintenance and simulated fault drill; 2.Any network or equipment failure or configuration adjustment other than the equipment to which Baidu AI Cloud belongs;
          2. Hacker attack to clients' applications
          3. Loss or disclosure of data and passwords caused by improper maintenance or confidentiality of users;
          4. Clients' ignorance or authorized operations
          5. User's failure to follow the usage documents or suggestions of Baidu AI Cloud products, such as unavailability caused by the users' operating on the Baidu AI Cloud database DocDB for MongoDB instance in the control mode of console, API or CLI;
          6. Errors caused by software installed by the customer or other third-party software or configuration not directly operated by Baidu AI Cloud
          7. Any network or equipment failure or configuration adjustment other than the equipment to which Baidu AI Cloud belongs;
          8. Force majeure and accidents;
          9. Other non-Baidu AI Cloud reasons caused by the unavailability.

          Compensation Plan

          3.1 Compensation Standards

          For a single cloud database instance, if service availability is lower than 99.95%, you can obtain compensation under the criteria given in the table below. The compensation mode is limited to buy vouchers of Baidu AI Cloud database and the total amount of compensation shall not exceed the monthly service fee that service availability promises customers to pay the Baidu AI Cloud database DocDB for MongoDB instance (excluding vouchers to deduction of expenses).

          Service availability Amount of the compensation voucher
          Less than 99.95% but equal to or higher than 99% 15% of the monthly service charge for this instance
          Less than 99% but equal to or higher than 95% 30% of the monthly service charge for this instance
          Less than 95% 100% of the monthly service charge for this instance

          3.2 Time Limit for Compensation Application

          Customers can claim compensation after the fifth (5) business day of each month for instances of the Baidu AI Cloud database DocDB for MongoDB unavailable last month. Claims must be limited to two (2) months after the end of the relevant month when the Baidu AI Cloud database DocDB for MongoDB does not reach service availability. The compensation application exceeding the time limit is unacceptable.

          4. Other Information

          1. Baidu reserves the right of final interpretation of this agreement to the extent permitted by laws and regulations.
          2. Baidu AI Cloud has the right to amend the SLA clause once this agreement is published and becomes effective immediately. If there are any changes to the SLA provisions, Baidu AI Cloud will notify you through website publicity or email. If you do not agree with the modification of the SLA made by Baidu AI Cloud, you shall have the right to stop using the Baidu AI Cloud database DocDB for MongoDB service. If you continue to use the Baidu AI Cloud database DocDB for MongoDB service, you are deemed to have accepted the modified SLA.
          3. All notifications of Baidu AI Cloud database DocDB for MongoDB service under this agreement can be made through web page announcement, in-site letter, e-mail, short messages, or other forms. Such notice shall be deemed to have been delivered to the addressee on the date of dispatch.
          4. The conclusion, execution, and interpretation of this agreement and the settlement of disputes shall be governed by Chinese laws and subject to the jurisdiction of Chinese courts. In the case of any dispute between both parties regarding the content of the agreement or its execution, both parties shall try their best to resolve it through friendly negotiation. In the case of failure to resolve the dispute through negotiation, either party may bring a lawsuit to the Haidian District People's Court, Beijing.
          5. This agreement constitutes a complete agreement between both parties on the matters agreed in this agreement and other related matters. Except as provided in this agreement, no other rights are granted to the parties to this agreement.
          6. If any agreement in this agreement is totally or partially invalid or unenforceable for any reason, the remaining agreements in this agreement shall remain valid with binding force.
