Share

We treat your information with a high degree of diligence. We do not share your information with any company, organization or individual other than Baidu AI Cloud and its affiliates, except in the following circumstances:

1. After obtaining your explicit consent, we share your personal information with other parties.
2. Share under legal circumstances: We may share your user information externally according to the provisions of laws and regulations, demands of litigations and arbitrations or requirements of administrative and judicial organs in accordance with the law; provide the regulatory agency or third-party platform with the information of the website organizer, the principal and the person in charge of the website, information about living person verification of the one in charge of the website (facial recognition) and relevant website information that you provide for verification and comparison according to the requirements of laws, regulations and regulatory provisions.
3. We share personal data with suppliers or partners who represent us to achieve the purposes in this statement. Some of our services are provided by trusted partners. To complete certain transactions and provide products or services you request, we may share some of your personal information with partners to provide better customer service and user experience. We only share your personal information for legal, valid, necessary, specific and clear purposes, and only share personal information that is relevant to the provision of services. Our partners have no right to use the shared personal information for any other purpose.

At present, our authorized partners include the following types:

(1) Service platforms or service providers. Baidu AI Cloud has access to rich third-party services (such as services provided by cloud market service providers of Baidu AI Cloud). When you choose to use the third-party service, you authorize us to provide your contact information to the third-party service platform or service provider so that it can provide you with services based on the relevant information.

(2) Agents or authorized service centers. Baidu AI Cloud cooperates with agents or authorized service centers to provide you with consulting, pre-sales assistance, basic technical services and other services. You authorize us to provide your necessary personal information to the above units so that they can contact you and provide you with high-quality services.

(3) Software and hardware/system service providers. When third-party software and hardware/system products or services are combined with Baidu AI Cloud products or services to provide you with services, with your authorization, we provide your necessary personal information to the third-party software and hardware/system service provider for you to use the services, or for us to analyze the use of products and services and to improve your experience.

Please note that the privacy policy of third-party service providers may be different from that of Baidu AI Cloud. If you provide personal data to the products or services it provides, the relevant data are governed by the privacy policy of the third-party service provider.

4. To facilitate us to provide you with services based on associated accounts, recommend information that you may be interested in or protect the personal and property security of Baidu AI Cloud affiliates or other users or the public from being infringed, your personal information may be shared to our affiliates. We only share necessary personal information (for example, to facilitate you to use Baidu account to use our affiliates’ products and/or services, we share your necessary account information with affiliates). If we change the purposes of using and processing the personal information, we seek your authorization again.
5. For companies, organizations and individuals with whom we share personal information, we sign strict NDA agreements with them, requiring them to handle personal information according to our instructions, this privacy policy and any other relevant confidentiality and security measures.

Transfer

We do not transfer your personal information to any company, organization or individual other than Baidu AI Cloud and its affiliates, except in the following circumstances:

1. Have obtained your explicit authorization or consent in advance;
2. If we or our affiliates are involved in transactions such as mergers, divisions, liquidation, asset or business acquisitions or sales, your personal information may be transferred as part of such transactions. We will inform you of the situation, ensure the confidentiality of such information during transfer and require the new company or organization that holds your personal information to continue to be bound by this privacy policy, otherwise we will require the company or organization to obtain your authorization and consent again.

Public Disclosure

We only publicly disclose your personal information under the following circumstances:

1. Based on your demands, disclose your designated personal information in a disclosure method that you explicitly agree to;
2. According to the requirements of laws and regulations and mandatory administrative enforcement or judicial requirements, if your personal information must be provided, we may publicly disclose your personal information based on the required personal information type and disclosure method. We prudently review all requests to ensure that they have a legal basis. When we receive the above request for information disclosure, we require them to issue corresponding legal documents, such as summons or investigation letters. We recommend law enforcement organs to contact you directly so that you can provide relevant data to them by yourself. If we are obliged to disclose your data to law enforcement organs, when permitted by laws and regulations, we notify you immediately and provide a copy of the request.

Exceptions for Prior Authorization and Consent for Sharing, Transferring and Publicly Disclosing Personal Information

In the following circumstances, sharing, transferring and publicly disclosing your personal information do not require your prior authorization and consent:

1. Relevant to our fulfillment of obligations stipulated by laws and regulations;
2. Directly relevant to national security and national defense security;
3. Directly relevant to public security, public health and major public interests;
4. Directly relevant to criminal investigation, prosecution, trial and sentence execution;
5. Where it is for protecting your or other individuals’ life, property and other major legal rights, but is difficult to obtain your consent;
6. Your personal information is disclosed to the public by yourself;
7. Collect personal information from legally publicly disclosed information, such as legal news reports, government information disclosure and other channels;
8. Necessary for signing and performing contracts according to the requirements of the subject of personal information;
9. Necessary to maintain the safe and stable operation of the products or services provided, such as discovering and disposing of product or service failures;
10. Other circumstances stipulated by laws and regulations;
11. Behaviors of sharing and transferring personal information that has been de-identified, and ensuring that the data recipient cannot restore and re-identify the subject of personal information according to laws and regulations are not deemed as publicly sharing, transferring and disclosing personal information, and it is not necessary to notify you and obtain your consent for storage and processing of such data.
